My Clinical Experience Essay
During my first day of clinical, I experienced an issue that I accept is critical. As an understudy nurture, our obligation during the current day was to follow our human services helper around the ward and help with finishing inhabitant care. The inhabitant required help with a significant number of her day by day errands. The medicinal services helper inquired as to whether I would perform one of those and do perineal consideration for her. I turned down her offer since I didn't feel good with my ability level. The inhabitant had a solid discharge during the night. There was a noteworthy scent in the room that overpowered me. I truly needed to leave the room since it was so unsavory, however I remained in the room with the goal that the inhabitant would not be humiliated. This sentiment of humiliation, I accept, was at that point present yet I chose to proceed with helping tidy up and change her materials. The issue that appeared to be huge, in this experience, was my emotions relating to insinuate care. Ã'One of the reasons why there is so small preparing here could be on the grounds that the demonstration of giving personal consideration to others can be considered as Ãdirty workâ and is underestimated both inside administrations and by the more extensive societyâ' (Clark, 2006) in the public arena, setting off to the restroom is viewed as a private issue and isn't done out in the open. During this experience, this was conflicting with my convictions of our accepted practice and getting this, I went with my benefits of mindful and supporting people deprived by remaining in the room. During this circumstance, I was attempting to accomplish my job of an understudy nurture while being proficient in my activities. I did what I accepted was directly as opposed to following social orders standards. Assessing the issue with persistent and my very own issues, I settled on a choice that followed my ethics and qualities. I decided to respond emphatically to the current circumstance while gaining for a fact and following what I accepted was morally right. Outcomes that may have emerged for the patient originate from the way that my strategies dislike the human services assistants and were solid and awkward, which I can just envision caused distress. It took longer than expected for me to finish my undertakings in view of my own uncertainty in my expertise levels and measure of understanding. The social insurance assistant I was with at first referenced that movements were exceptionally close for time and for completing things she noticed that she comes in right on time to guarantee things run smoothly,â just in the event of confusions, for example, my present circumstance. My social insurance associate may not feel as certain about my activities as she may have been on the off chance that I decided to at first take an interest regardless of my own issues with close consideration. Having lost trust in my capacities to manage troublesome and new circumstances ended up being the outcomes of my activities. Having more certainty and monit oring circumstances that may conflict with my convictions and individual issues may have permitted me to have a superior first day. The social insurance helper was extremely strong of my activities and commended my endeavors afterward for stepping in during my first time in a troublesome circumstance. I can envision the inhabitant was feeling some pain and humiliation, as she was unable to control her activities and was exceptionally appreciative a short time later. In spite of the fact that feeling inconvenience during the occasion, I was exceptionally satisfied subsequently. There were a couple of components that impact my sentiments, considerations and reactions during this experience. The sentiment of inconvenience in performing personal consideration got evident sometime later when I started thinking about my clinical experience. I was not set up for the measure of cozy consideration that was available. Detecting others' emotions is a characteristic that I have created while being available in the medicinal services territory and showing field, and alongside my ability level, in nursing had a major influence in my contemplations and reactions during this experience. In spite of the fact that having thought about my incredible grandma previously, this was my first day encountering personal consideration with an inhabitant. Taking part practically speaking labs, class conversations and learning exercises permitted me to have the information on performing such obligations and a comprehension of how close to home we would get, yet didn't understand how it would influence me. Giving myself an opportunity to look into nursing encounters, going to progressively clinical practice labs, taking an interest and viewing these obligations in the human services setting will permit me to build up a safe degree of certainty whenever that this kind of circumstance may happen. Remaining in the room permitted me to encounter the sentiment of help while looking past normal practices and how they are tested. I met my own qualities, and I accept that one shouldâ respect someone else's protection. This comprehension permitted me to be there to help the occupant during her period of scarcity. In the article 'beginning' by Jane Schulz, a nursing understudy shares her experience of helping her partner help an older patient with day by day care. Watching the sympathy and care among medical caretaker and patient from central errands, she removed an esteemed exercise of how our help and caring strategies influence a person. My connection to this story permitted me to ponder the impacts my consideration and supporting activities had on our patient. Having finished perineal consideration on puppets in class has been my lone past experience that I have experienced with close consideration. When given new circumstances, I have a propensity of taking care of them very well with certainty. My response to imply care was because of the uneasiness with the measure of get in touch with one has with sexual body parts and natural liquids. I recognize what's in store whenever gave a comparable circumstance later on, having had the experience I accept that I will see how to deal with my feelings and present an agreeable situation to more readily think about the patient. The main way I can be OK with close consideration is to take an interest in principal minding of patients and learn through understanding. If I somehow managed to modify my activities by leaving the room as opposed to remaining to help and bolster my occupant, the ramifications for my activities may have been because of an absence of trust in my aptitude levels from my human services aideâ's perspective, and my own. It was evident that the inhabitant was not happy and required assistance. Not giving my occupant the consideration she merits may have left her feeling like she was not significant. Leaving the room would add to my perspective on societyâ's standard that setting off to the washroom is a private issue and I would not have increased any understanding to build up my aptitude levels and certainty. Considering my clinical experience has made me mindful of my qualities and shortcomings in my own and nursing aptitudes. I have removed a great deal from this experience; as I have run over an individual issue of experience difficulty managing cozy consideration. I have built up a comprehension of accepted practices and how they can influence ones suppositions. This experience has enabled me to adapt in new circumstances for what it's worth and will consistently be an aspect of my responsibilities. Building up an approach to manage private consideration as well as could be expected will permit me to think about my customer and ensure their emotions [embarrassment] and security are being regarded. Coming out of this circumstance understanding my slip-ups, my degree of certainty will without a doubt climb and set me up for my picked field. According to Carperâ's methods of knowing (Carper, 1978), I demonstrated feel by assessing the circumstance all in all. In spite of having the inclination to leave the room, I perceived the inhabitants requirement for help when being confronted with an issue that resisted our accepted practice. Moving past the surface and being genuinely and intellectually at the time with the inhabitant permitted her to encounter the consideration they merits through my strong and supportive activities. I demonstrated ethic methods of knowing when I comprehended that perineal consideration is something I accept was ethically right. I had a feeling that I must be there for my patient when they required me and ensure the consideration and bolster was available. Standing up to my convictions changed my sentiment on societyâ's standards; I utilized my qualities and ethics to control my activities. My own methods of knowing create through my involvement in close consideration. I finished an errand that I was not happy with doing and accepted was a private issue. I chose to help in the experience in the wake of assessing the patientâ's degree of distress and need of help. Until I experience a comparable circumstance, I won't know whether my responses will be the equivalent, yet I will realize that I have the right stuff and capacity to do it. I indicated my exact methods of knowing by dissecting the article ÃPrimary Care Nurse Practitionersâ' Integrity When Faces with Moral Conflictsâ via Carol Ann Laabs comparable to my involvement in private consideration. The motivation behind this article was to show the investigation of nurseâ's concern with moral honesty in essential consideration. It reasoned that ethical clash is basic inside a whole gathering (for example staff, group, colleagues) and keeping ones good uprightness causes them to feel extraordinary about their activities in an essential manner while keeping on an expert level. This interfaces with my experience as I was in a circumstance where I needed to settle on a choice inclu ding my ethical respectability and do what I trust I could do dependent on my qualities. This experience helped me to challenge my moral convictions and make decisionsâ based on what I accepted was correct. This experience has changed the manner in which I will take a gander at new circumstances with personal consideration and ones that I will experience later on. I finding that our instruction can just guide us, however the experience permits us to build up our sentiments and convictions. By finishing this impression of my clinical experience I discovered that I had a concealed individual issue with cozy consideration. Close consideration is characterizes as care undertakings related with real capacities and individual cleanliness which requests immediate or roundabout contact with or presentation of the sexual pieces of the body. How to trick yourself into thinking that youre writing a report
How to trick yourself into thinking that youâre writing a report Do you have trouble writing? Does it feel like a daunting, excruciatingly slow, and unpleasant task no matter how you approach it? Have no fear, for I am here to teach you how to trick yourself into thinking that youre writing a report, and feel completely productive and proud of yourself when you do. This post burgeoned from my experience with 20.109, or Laboratory Fundamentals in Biological Engineering, this semester, and you can read it along with all my classmatesâ posts on our class blog here. This was the first technical communications class I took at MIT, and it has definitely opened up a brand new skillset for me to flounder in and ultimately improve. It has actually been an enjoyably challenging and fascinating course, solidifying my decision that double majoring in Biology and Biological Engineering was a wise recent move. _____________________________________________________________________________________ The Optimal Procrastination Technique: How to trick yourself into thinking that youre writing a report I would like to share with you an amazing strategy Iâve had the pleasure of discovering via 20.109 this semester. You see, through tireless effort, countless attempts, and endless hours dedicated to grinding out reports for this course, I have finally discovered the most optimal procrastination technique. It is so effective, in fact, that at times it will irrefutably convince you that it is not procrastination, but work of the utmost and immediate importance. It may seem difficult to implement at first glance, but believe me, once you train yourself to stop the urge to write your results down and get the report over with, you will find this technique very easy to master and even quite enjoyable. In the end, you might figure that is it too overwhelming or unnecessary to actually write the report anyway, and your problem is solved! Curious? There are two key steps to for this process to work. 1) Read all of the related literature. ALL of it. Read it in depth and pay attention to all the details. Follow the tangentially-related references and whatever you do, donât stop reading until youâve learned the complete history and current state of the field. Figure 1: Schematic demonstrating the process from a more relatable starting point. However, this is biological engineering research, so I recommend you begin the voyage from PubMed, or at least google scholar. (Xkcd 2007). I know, it sounds quite challenging at first. After all, you might just read a few papers and feel like you have a pretty good understanding of what is going on in general and how it fits into the experiments you did in class. DO NOT LET THIS FEELING FOOL YOU. I repeat, you have not learned enough yet. For example, you have to understand that itâs important to read beyond just all of the literature on âKu80 related NHEJ-repair in CHO cells,â which is probably under 10 papers anyway. Have you at least learned everything about the Ku80 protein? Do you understand its crystal structure? Whatyou didnât know the crystal structure was elucidated in 2001? Then how are you to possibly understand the molecular mechanism by which it resects double stranded DNA breaks? Arenât you curious about the differential repair results of your specific cut topology? I mean itâs your precious, darling, unique break-site architecture for crying out loud! Once you feel like you sufficiently unders tand enzyme-DNA dynamics, you can move onto exploring all of DNA repair, or at least homologous repair which you can frequently mentally compare. Donât forget to really explore all the sub-branches, mechanisms, and implications. Itâs also really important that you donât have a system for organizing all the useful portions of the literature that you readâ"downloading entire pdfs and dumping them into a folder or bookmarking the tab (try to keep switching it up for fun) should work fine. If thereâs anything you donât understand, a method or a term, immediately open a new tab (Figure 1) and learn about that until your computer overheats or the deadline for the report has passed. Take home message: Donât feel limited in your exploration! Remember, the point of your MIT education is to learn as much as possible. 2) Make all of your figures before you write anything. Then continuously remake them. Generate many types of visuals from the same data set. Keep changing them as you find little errors or large mistakes in reasoning. Try to make a large supplementary figure section to make sure your reader has a thoroughly comprehensive visual guide to your report. This is the fun part, so give yourself every excuse to keep working on them. Ok, now that you have sharpened your critical reading skills, itâs time to move on to the artsy design skills youâve dreamed of developing ever since you first used Microsoft paint in second grade. In fact, for nostalgia or for lack of more complex software, you should probably do all your figures in Microsoft paint. Sure you can plan them out in PowerPoint or Illustrator, but make sure to always drift back to Paint for any finishing touches. See how fun it is to manipulate each pixel? There is such a joy in eyeballing where things should be without those pesky guidelines always snapping and giving away the alignment solution! Make sure to spend a lot of time on font, text size, color palette, and especially about positioning the images into your report. This last step is particularly key because you have no idea how the text in your report is going to ultimately look like, so you might as well define it with images first. The text will then easily follow into the spaces youâve confined. After all, if your report doesnât look publication quality then how can it possibly contain useful information? So definitely make sure that the figures, and not the text, carry your research. This is also where many versions of the same image come inâ"if it doesnât look âprettyâ then have you tried changing the significance threshold so your error bars are smaller? You might as well take off the bottom error bars that annoyingly cross the axis anyway, since your audience is scientifically literate and understands that the range is symmetrical. Also, try to log transform your data and otherwise deviate from any âoverly-simpleâ representation to really show that you are a researcher concerned with presenting compelling and clear visual results. Oh god waitâ"is that a formatting inconsistency? Remake your figures and watch as they grow more beautiful and more plentiful! Hopefully someday research can progress to where readers can follow the images and just rea d between the lines, you know? Then you donât have to explain anything; just look at the graph people! After youâve exhausted all possible data files and their representations, you should contemplate a side-career as a picture book author, which is perfectly suited for your visually-dominating, textually-minimalistic approach. Congratulations! After these steps you should have a lot more files on your computer than when you started! You really have done so much work on this report; you temporarily know everything ever and just look at all those figures!! In fact, at this point you should feel pretty finished, since the remainder of the report is just filling in the wordsâ"trivial. In fact, it probably feels pointless to detail your results now anyway since youâve realized itâs all mostly been done before, more carefully and much more impressively in the actual literature. So you should probably just go take a nap, since it took a lot of effort and time to truly master the most productive procrastination approach to large writing projects. You only lose 1/3 of a grade per day for late work, so I encourage you to continue implementing this process after the initial due date. Good luck! _____________________________________________________________________________________ All of the above advice was directly from experience, hah. It turns out that my new love for reading scientific literature was procrastination all along?! Anyway, as a junior, I feel like I have experienced a complete learning shift at MIT this year. The learning shift is roughly from learning how to problem-solve, to learning how to communicate the results of your problem-solving. In the past three months, I have written more technical writing (due to class work and UROP) than the sum of all months prior in my life. This has involved a complete change in habits and mindset. Previously, it has not been difficult to âget byâ, as in to pass classes, through adequate exam performance. Whether through regurgitation or manipulation of knowledge (even hastily acquired cursory knowledge from the night before turned morning of), a problem could always be attempted and partial credit could always be earned for effort, synthesis of ideas, and correct train of thoughts (trains of thought? trains of thoughts? being on the right track? all aboard the thought-train!), even if the final answer was incorrect or incomplete. Now, incomplete or incorrect results wonât cut it. The requirement now is not only functioning results, but the ability to describe the background, production, and implications of aforementioned results in a technical, concise, and effective manner. This year Ive really grown in my academic realm, and now Im feeling the time limit before graduation sink in. Now that Im finally mastering MITs intensity and becoming deeply engrossed in my field, I realize I only have one year left and I should already be making plans for the future (what whyyyy I just got hereeeeee). The main skills Ive been developing is being able to grind work out consistently instead of just before (or after) deadlines, and not have a fear of and self-defeating approach to writing. Therefore, I welcome the blarghonetowebosphere (Figure 2) reading my experiences even if Im irrationally nervous about (or maybe just unnecessarily dreading/making a big deal of) writing them, and I will hopefully proceed to pump out more stream-of-consciousness posts about MIT life before its too late*. If you have any questions about MIT, feel free to contact me at [emailprotected]! *before I graduate, not before I lose consciousness Figure 2: You can never have too many perfectly reference-able xkcd comics. You should read Joels post. (Xkcd 2006).

All About Common Chinese Punctuation Marks
Chinese punctuation marks are used to organize and clarify written Chinese. Chinese punctuation marks are similar in function to English punctuation marks but sometimes differ in the form or look. All Chinese characters are written to a uniform size, and this size also extends to punctuation marks, so Chinese punctuation marks usually take up more space than their English counterparts. Chinese characters can be written either vertically or horizontally, so the Chinese punctuation marks change position depending on the direction of the text. For example, parentheses and quotation marks are rotated 90 degrees when written vertically, and the full stop mark is placed below and to the right of the last character when written vertically. The Death Of King Hamlet - 960 Words
The death of King Hamlet effected many individuals lives to the point where great changes were made. Especially in regards to his son, Hamlet, who took the death ââ¬â murder- of his father personally in both mental and emotional ways. By doing so, Hamlet portrays and experiences the death and loss of his father by acting out in manners in which magnify his isolation and alienated actions. These would include excluding and distancing himself, turning on those closest, and taking on measures one would never do so when thinking rationally or clearly. Hamlet attended the University of Wittenberg, which implies his great intelligence amongst all his other peers, as well as his age as he is entering manhood when this conspiracy occurs. Hamlet is supposed to be, in the eyes of the country of Denmark, becoming a man and learning about the responsibilities and tasks in which need to be performed in order to take care of and rule of not only the state but also the people. However, instead of doing so, Hamlet becomes engaged in his fathers murder, in which turns his attention to seeking revenge on his uncle, the man who committed the crime. One with such high education and connections well throughout the state would assume to have thought of a greater plan of revenge rather than death. As with power also comes strength, Hamlet did not have to go to such lengths of madness, and isolation in order to achieve such end of means. Hamlet also deals with the death of this father byShow MoreRelated Comparing the Tragedies of Hamlet, Oedipus the King, and Death of a Salesman1023 Words à |à 5 PagesComparing the Tragedies of Hamlet, Oedipus the King, and Death of a Salesman The tragedies Hamlet, Oedipus the King, and Death of a Salesman have strikingly different plots and characters; however, each play shares common elements in its resolution. Gender Role Controversy free essay sample
Gender can be defined in many different ways based on the opinions of the person you are asking. To me, I believe gender refers to the behaviors and roles that our society deems appropriate for men and women. Although gender roles have changed over time and males and females have become more equal, a certain stereotype of behaviors and tasks which are acceptable for men and women still exists today. For example, cooking and cleaning, home repairs, and being the ââ¬Ëbreadwinnerâ⬠in the family are all tasks which we as a society usually perceive to be done more often by one gender over the other. Cooking and cleaning has been seen as a womanââ¬â¢s job in the household throughout history. When women could not work and had to raise children at home, they built the stereotypical standard that women need to stay home and cook and clean and raise babies, because that is literally what women did at one time in history. We will write a custom essay sample on Gender Role Controversy or any similar topic specifically for you Do Not WasteYour Time HIRE WRITER Only 13.90 / page However, with the growth of more women getting jobs during wars when their husbands were overseas, going to college, and becoming more equal with men, the stereotype has somewhat dissolved. Women currently make up almost half of the workforce, yet many occupations remain gender segregated (U. S. Department of Labor, 2005). For example, mechanics, construction workers, and firefighters are careers mostly dominated by males, whereas child daycare, event planning, and fashion and design related careers are typically dominated by women. Many groups of people, both men and women, still believe that women should stay at home and do their ââ¬Ëwomanly dutiesââ¬â¢, but that is not the reality of the society we live in today. On the other hand, men have stereotypes as to what they should do in a household as well. Society has been complacent with the idea that men do all the ââ¬Ëdirtyââ¬â¢ work, like home and car repairs, killing bugs in the house, going to investigate a noise heard within the house, and other ââ¬Ëmasculineââ¬â¢ tasks such as those. This stereotype also evolved from our history, when women turned to men to do those jobs because they did not know how, or it was seemingly wrong in society for women to perform such tasks. This certain stereotype is still more prevalent than not in our society, however it has been less one sided in the recent years. Women now know how to fix cars, do home repairs, and it is more acceptable for women perform these and other tasks that were once solely dominated by men. A final gender issue formed and shaped by our society has been that men are the ââ¬Ëbreadwinnersââ¬â¢ in the household, or that they got out and work and make the money to bring home to support the family. This stereotype is becoming less and less common in society, where living expenses have gone up and families now need the income of both spouses to survive. However, many people still want to, and have the means to, live with those beliefs. In addition to this belief, empirical research has consistently shown that, on average, men are paid higher wages than women ( Beblo 1). This is true even when the man and woman have the same exact job, and have the same exact education and qualifications for said job. Women are now going to college and earning degrees just as readily as men, and therefore can obtain the same jobs as men, something unheard of in the past. It is now normal to see a woman CEO, president, or head of a company. It is normal for a woman to have a degree and career in any field that they want to, for it is now possible and acceptable by society. Gender and Sex issues are a wide variety of topics that can be debated back and forth. Our society today has shaped our views and our prejudices towards certain aspects of gender roles and stereotypes that certain genders have. Women are stereotyped to be home bodies that cook, clean, and have children and raise them. Men are stereotyped to do the masculine jobs around the house, and go out and bring home the money for the family. These roles and stereotypes are dissipating throughout our society as society grows and develops, and becomes more equal. However, some stereotypes are still fully believed by some people, because that is how they were raised.

Various historical eras had different views on leisure and recreation, and they treated them differently. In past historic eras, leisure was viewed as exploitation, but this perception has greatly changed over the years. However, there are some similarities on issues related to leisure and recreation in the past and modern times (Ritchie, 1994) The industrialization era, which occurred in the 19th century, was characterized by rapid improvements in the industries in terms of production. Industrialization profoundly influenced leisure and recreation during this era. The church was not in favor of leisure and instead promoted work, which they highly valued. There was an incident in 1844 where Henry Ward Beecher, a minister, stormed the stage of a concert hall condemning commercial entertainment. In the 1880s and 90s church leaders started favoring play and even provided libraries, assembly halls and gymnasiums (Goodale Godbey, 1988). Churches have continued to promote leisure through organizing and financing of leisure activities. However, despite the banning of the theatre in the earlier period, they started gaining popularity. Drinking was also a major form of leisure during the period just as in modern times where people meet up in bars for a drink just to have fun, interact or even relax after work. Professionalism in sports emerged during this era and has continued to develop in present day where sportsmen earn a living from sporting activities. Countries also hold inter-country sports competitions that promote cohesion. Colleges in the United States were not left behind, they started the first competitive sports events (Goodale Godbey, 1988). This included sports such as baseball, rowing and track. This has continued over the years where inter-school competitions are held in various parts of the world. Football also became a major sporting activity featured in the intercollegiate sporting events and competitions too, and it has continually grown roots in the recreational field and has become one of the most popular sports in the world. The industrialization era had various effects on modern times when it comes to leisure and recreational activities. During this period, various developments promoted recreational activities and facilities. First, the adult education movement that was concerned with adult civic education. Through this, there was an expansive development in reading as a form of recreational experience. A promotion of culture through arts and crafts was also experienced and this promoted study of art in learning institutions. This influence is evident today through the number of libraries stretched across the world, the number of books and other written material published today, the internet is also a clear indication of this development since it provides all sources of written information that one may require. Preservation of natural heritage also began in this period. The Congress took the first step in preservation in1864 where it set aside a large piece of land for recreational purposes. The first state parks were also set aside in the era .these steps widely contributed to promotion of leisure in modern times since these parks are still used to date. People spend their leisure time visiting these places (Murdy, J. J., 2004). Founding of voluntary organizations such as the Young Menââ¬â¢s Christian Association also played a great role in promoting recreational activities especially for the youth and for the children. This has influenced the voluntary organizations to continue contributing in the field of leisure and recreation. Various playgrounds such as the Boston Sand Garden were established where people could play. The Boston Sand Garden was specifically formed for children. Such grounds are in existent up to date and they have widely promoted recreational activities since they are used to host sports events. During this era, many sporting activities emerged such as wrestling matches, shooting matches, foot races. Women also began enjoying recreational activities such as dance, athletics, gymnastics, and physical education. Towards the end of the 19th century, there was a wide emergence of outdoor activities such as hunting, mountain climbing, which have continued to be major sports in modern world (Goodale Godbey 1988). Economic factors in this period also contributed to promotion of recreation act ivies in the 1800s. Since there was increased wages paid to the workers who also had shorter working hours, the workers started participating in organized sports. There were also cheap train transportation services to move players and the fans to sports events. This could be interpreted in modern times as government support on recreational and leisure activities. Governmental support is demonstrated in labor laws that promote the welfare of workers and prevent their over-exploitation giving them leisure time. Another way in which the government has been on the frontline in promotion of recreational activities is through funding. It has been financing various sporting events and motivated sportspeople through various compensation schemes. The past historical erasââ¬â¢ developments had a lot of influence on the current age leisure and recreational activities. It is from these developments that todayââ¬â¢s leisure shapes itself to what we see today. Specifically the industrialization era where many changes occurred in terms of development in the economic field and other fields, which developed into the modern world that is full of developments, is a good comparison to the modern views on leisure. Various steps that were taken in that era have made great impacts in the field of leisure and economic activities. They have ensured continued development in this area over the years. Though many saw, no one so much as called the police. They all just watched as Kitty was being stabbed to death in broad daylight. They watched as her assailant walked away. Case Study involving Trust laws Example | Topics and Well Written Essays - 1000 words
Involving Trust laws - Case Study Example Although the law is dealing with the Property Act it also extends to other aspects of equitable interest. Under the Section 5 (1) of the Wills Act, 1988, ââ¬Å" it is seen that every person may dispose by will, executed in accordance with this Act, of all real estate and all personal estate owned by him at the time of his deathâ⬠(Wills Act 1988. 2005). In this case it is seen that a trust has been created in favour of Ben and he has nominated Richard to hold the 2000 shares in trust on his behalf. Through his written will, he has directed that 950 of the above shares may be bequeathed to his Accountant, Tom, to be held on behalf of his nephew, Andrew, the legal beneficiary of the gifted shares. In the decided case of Goldcorpe RE 1995, 1 AC 74, claims for non allocated bullion could not be enforced. Ordinary members of the public were inveigled into investing in non-existent bullion, on the strength of allotment letters given to them for staking their claim on future bullion. When Company subsequently went into liquidation, they claimed beneficial interest on future bullion on the basis of this allotment letter. The Courts held that the bullions were not earmarked and could not be enforced. In another decided case of Saunders v. Vantier(1841) 4 Beav.115, a trust was created that upon the death of the uncle, certain shares would be bequeathed to the nephew, along with its incomes, till he reached the age of 25. The nephew laid claim to the gift upon reaching the age of majority, i.e., 21 years. The Courts held that the validity of the gift had passed on from the uncle to the nephew upon his passing away, it being intended to be an immediate gift. Therefore, the claim for the property to the nephew from the uncle was passed on immediately upon his gaining majority age: (Theriault 2002). The case of Hunter v Moss (1994), whose decision was delivered before the Gold Corpe Re (1995) case, 1 AC 74.which relates to 50 shares of a total of 950, being verdicted to be a genuine trust, without uncertainty of matter, which was not considered in the case of Gold Corpe Case (1995). The Court of Appeals, in this case, validating the decisions of the High Court (1993) I WLR 934, stated that a statement of trust, of, effectively 50 shares out of a total number of 950 shares in a Company, could not be said to be a void contract, on the grounds of the uncertainly of subject matter; in this case the learned judged observed that allocation of particulars shall be considered superfluous since all the shares carry

Taisho period Essay Example | Topics and Well Written Essays - 1750 words
Taisho period - Essay Example (Minichiello S. (1998) Japan's Competing Modernities: Issues In Culture and Democracy, 1900-1930, p.3) It is also marked by serious pollution problems, resulting from Meiji industrial policy. Except for these tendencies, the health of a new emperor was weak and this fact led to the shift in political power from oligarchic clique to the parliament and democratic parties. It is customary to call this shift and the related events the Taisho democracy. (Minichiello S. (1998)) Large, Stephen S. (1983) states that at the beginning of the century a growing mass consciousness represented a main tendency in social life. Due to increasing taxation, people wished to play more significant role in social life, thus increasing a number of voting people. One of the most remarkable demonstrations of popular unrest was Hibiya Riot that occurred because oligarchs didn't inform people about the events of war. In the period between 1905 and 1918 economy of Japan changed from agricultural to industrial, while Japan was looking for export market for the new commodities. One of the most remarkable facts of social life during Taisho period was the growth of the population. The agricultural pattern remained the same, but industrial cities grew. This growth may be either a result of the migration from countryside to the cities or a natural growth of the urban population.( Minichiello S. (1998) Japan's Competing Modernities: Issues In Culture and Democracy, 1900-1930, p.7) The researches distinguish between agricultural and non-agricultural economy in prewar Japan. They point out the following reasons for this differentiation: the agriculture reached the top of its output, for greater income it should have changed to larger-scale agriculture but this process could conflict with the social structure; the economic consequences of imperialism, when colonies produced food, depressing agricultural prices in Japan; the power of landlords remained the same so the tenancy problem wasn't resolved. (Minichiello S. (1998) Japan's Competing Modernities: Issues In Culture and Democracy, 1900-1930, p.7) Large, Stephen S. (1983) writes that after the 1st World War the exports failed, and inflation grew. These circumstances aroused economic opposition to governing classes; a number of mass demonstrations grew, as well as the popular demand for participating in social life. In December 1912 collapse in the Cabinet of Saionji Kimmochi seemed to become a factor promoting the ideas of democracy, bringing broad political rights through universal suffrage and true parliamentarism. Yoshino Sakuzo was one of the representative thinkers (1878-1933), who invented the notion of minponshugi (people-centrism). Yoshino's idea of minponshugi enjoyed great publicity from 1916, and still is regarded as the ultimate liberal idea of prewar Japan. Yoshino's notion of minponshugi called for the redistribution of power and wealth in Japanese society by institutionalizing the political system of popular representation; and, by employing various social programs to protect the weak and poor. A new society - Shinjinkai appeared in December 1918. It based upon the dual platform - liberation of mankind and rationalistic reform of present day Japan. This organization was influenced firstly by English social democracy, and then it experienced the

Similarities and differences of youth justice systems
Similarities and differences of youth justice systems Introduction Different countries have their own different way of dealing with their young offenders. Youth offenses comprise a sensitive issue that ought to be handled with care. The youth justice system of any country is charged with the responsibility of dealing with young offenders. The paper is a review into the similarities and the differences of youth justice systems in England and Wales and Sweden in view of their youth justice systems. Barth (1992) emphasizes that there are many reasons as to why the youth engage in criminal activities among them poor parenting and lack of proper education. Different societies respond to crime differently and the response to a particular crime varies as societies evolve changing its values over time. For instance, during the olden days, the words rehabilitation and the rights of the child were rarely talked about but in the modern day our societies have changed and incorporated such concepts and this have affected the way we punish the youth. Societys definition of minor and major crimes has also changed over time (White, 2001). However, it is evident that as societies change over time and children who in the olden days were thought not in a position to commit crimes are now committing them. Justice systems have also evolved to cope with the changes in society. The youth justice system in light of the welfare of the child has come up with ways to deal with young offenders in a way that is different from the one that is used in dealing with adults and also a way that incorporates the welfare of the child. One factor is therefore clear that the youth justice system in England and Wales and Sweden have changed over time to keep abreast with the changes in crime activities involving the youths. In regard to England and Wales and in view of social disclosure, the proceedings and the verdict of a case where a person who is considered a youth has committed a crime, may be reported by the media but the persons identity is not to be openly disclosed to the public (Hill, Lockyer, Stone, 2007). According to Hill, Lockyer, Stone, (2007) in terms of social disclosure in England and Wales, the information is not reported to the public freely. Press members are restricted in terms of the information that they can report to the public. In addition, only selected members are allowed to the proceedings in which a minor is being judged. Only the members of the press, parents and guardian of the offender are allowed into the proceeding which shows that the justice system in England and Wales takes serous offence in disclosing criminal information regarding a minor. However, Sweden has a different approach to social disclosure involving young peoples offences. Young offenders in Sweden ar e not tried in a different court from their adult counterparts and therefore information relating to young people offenses is open to the general public. One of the ways that the youth justice system in England and Wales is similar to that of Sweden is through the use of restorative judgment. According to White (2001) England and Wales youth justice system aims at identifying youths who are at risk of engaging in offenses. The principal aim of the youth justice system in England and Wales is to prevent the youths in indulging in activities that can result in crime and hence the existence of youth offending teams in England and Wales. For instance, it is believed that if the youths have plenty of activities to indulge in they rarely engage in criminal activities. The interventions created allow youths to be occupied and hence lack the time to indulge in criminal activities. Similarly Swedens youth justice system is committed to preventing crimes occurring among the youths (Sundeen, 2002). This is done through the use of social welfare committees who take responsibility of the offenders and are in charge of reforming the youth. However, reformation of youth offenders in Sweden is compulsory. In economic sense, it is easier to have interventions and programs that prevent the youth from indulging in criminal activities than to wait until its too late and youths have to be sentenced to life imprisonment (Sundeen, 2002). Littlechild, (1997) suggests that decision making is crucial to all youths whether in Sweden or in England and Wales. Most of the times, it is argued that young people are not in a position to make decisions on their involvements in activities that are deemed as criminal activities by the law. In England and Wales, a young offender who is charged with a criminal offense is between the ages 10 years and 18 years while in Sweden, a young person who can be charged with a criminal offense is usually below the age of 15. At the age of 15 years and above, young offenders in Sweden are tried in the same courts as the adults. Drawing a sharp contrast in the two countries youth justice systems (Littlechild, 1997), the age at which a person is deemed an adult matters. Young offenders who are 18 years in England and Wales are tried in youth courts and therefore categorized as persons who are influenced by their age in decision making. Muncie, Hughes, McLaughing, (2002) points out that though the youth justice system in Sweden recognizes that young people are under a lot of pressure when making decisions, it does not offer any exceptions when trying young persons in courts between the ages of 15 years to 18 years. In England and Wales, a person who is 18 years and is being tried in a youth court has a better understanding of the youth justice system as compared to a person who is 18 years in Sweden and is being tried in a criminal court (Stephenson, Giller, Brown, 2007). Young offenders in England and Wales are at a better position of understanding the law in regard to criminal offenses as opposed young offenders in Sweden at the age of between 15 years and 18 years and who are tried in criminal courts. However, youth justice systems in both states also plays the role of ensuring that youths understand the repercussion of their negative actions and behavior in the society. Youth justice systems play a major role in legal referencing. It has helped in reprimanding the youths in both states though the approach to young persons offenders differs between the states. In Sweden, (Sundeen, 2002) the approach used in the youth justice system leans more towards the welfare of the young persons. The Swedish youth justice system focuses on the need of the young person and therefore instead of punishing the young offender, he or she is placed in the hands of the local authority which is in charge of the youth justice system. Even though young persons at the age of 15 to 17 years are tried in criminal courts, the courts place the responsibility of the young person in the compulsory social services in Sweden. In England and Wales, the youth justice system is oriented towards punishing the young offenders and making them pay for the mistakes they have done without the considering that the young person may have committed the crime due to various circumstances. It is a rgued that when a young offender is punished for his or her mistakes, he or she is likely to learn from the mistake because the punishment will serve him or her as a negative reinforcement associated with doing wrong. Over the years, youth justice systems have spurred debates as to their effectiveness in reducing criminal activities among the youth. Major policies in both countries (Stephenson, Giller, Brown, 2007) have become the subject of internal politics in the youth justice systems. For instance in England and Wales, there are some people who feel that when young offenders are taken to social welfare organizations, they interact with other young people who do not have a criminal background and might in turn learn the vices through socializing with the young offenders. Others feel that the youth justice systems are not instrumental in reducing criminal activities among the youth for instance in England and Wales while in Sweden, the youth justice system has done a commendable job. Therefore, in both countries, youth justice systems are subject to politics and scrutiny by even politicians. In conclusion, matters relating to crimes by young offenders are very sensitive. Each state handles its young offenders in different ways. It is apparent that criminal activities among the young people do occur and no gender is an exceptional. White (2001) argues that both girls and boys are capable of committing a crime. The state has the mandate of ensuring the safety of her citizens and therefore cannot let the young offenders go free committing crimes and without punishment. On the other hand, the young offenders to the state are the future leaders of tomorrow and therefore, the state needs to take care of them. According to Stephenson, Giller, Brown, (2007) interventions should focus on the needs of the youth and consequently help the young offenders reform and avoid indulging in criminal activities. A good example is the way Sweden handles its young offenders through a compulsory welfare program. According to Barry (1994) in Sweden, the needs of the child are carefully assesse d and the youth justice system is more interested in helping the child develop and learn from his or her mistakes than in punishing the young offender.

Many things can set apart the different people in the world, but a crucial characteristic that makes the world diverse is a personââ¬â¢s moral ethics and values. Ethics is a defining key that is shared by people all around for it is what people use to make decisions that impact themselves and the people around them. In William Shakespeareââ¬â¢s play Macbeth, Shakespeare expresses his own value of all deeds have consequences through the characters Macbeth, Lady Macbeth, Malcolm and the plot of the story. It depends on how you refer to the word consequences. Good or bad. ââ¬Å" Nought's had, all's spent, where our desire is got without content; 'Tis safer to be that which we destroy. Than by destruction dwell in doubtful joy.â⬠(3.2.7-9) This shows that getting what you want doesnââ¬â¢t always bring peace. Lady MacBeth is one of the most alluring female characters in Macbeth. She is evil and witch-like all at the same time. However, during the play we see her in two different ways. When we first meet her in the beginning, she is a brutally violent, power craving witch, and later on she turns into a shameful, suicidal, grieving, woman. Lady Macbethââ¬â¢s deception plays a big role in Macbethââ¬â¢s actions because she wished of nothing but the death of King Duncan. The problem was, she was a female and did not have the masculinity to murder someone so she used the next most capable power she had. Deception. She deceived Macbeth into killing Duncan. "Wouldst thou have that which thou esteem'st the ornament of life, and live a coward in thine own esteem." (1.7.45-47) She states that if Macbeth does not following through with the deed of murdering Duncan, he would make a coward of himself and would look foolish in his own eyes. After the murder of Duncan, Lady ... ...leader to follow and look to. To express his morals and values throughout the characters and the plot of the play, Shakespeare created a storyline that successfully gave each character a role that shows the turn outs of what would happen if ethical decisions were not made and displayed the way that they were supposed to. In his play Macbeth, Shakespeare is sharing to the audience that through every action you make, there is always a consequence that must be dealt with or a certain outcome that you must live up to. He does this through his characters Macbeth, Lady Macbeth and Malcolm. While not all people have the same set of morals as each other, everyone has the power to make the best or worst decisions. The aftermath of those decisions play into the lives of everyone around including their own and can either create great success in someones life or fatal tragedy.

Poetry
Alone In a dark room, -Every entity has left me here. -The door Is barred by a broom, Belonging to the witch who sealed my faith. -Curled into a ball -Knees to my chest, back against the wall. -This is my only protection. -Although the only breath I hear is my own, -I'm reminded I'm not yet alone. Lingering above me Is the everlasting pressure, -That makes my body wrack with sobs. -Cut, It whispers, The foul word drips with a venom even snakes envy. It swirls around me, -Taking in the sight of the cowardly abomination that is me. This may not be a pleasurable presence, -But at least I'm not abandoned. -Detached from all beings, this empty feeling must be my sole purpose. 2.Time bomb ââ¬â 2014 -You're Like a time bomb -Ticking endlessly -She's walling for you to explode Stabbing her with the millions of scattered pieces you'll have broken into -It's only a matter of time -As she watches you fading -You're falling apart before her eyes -and she is trying desperately to do -what all the kings horses and all the kings men couldn't -But she can't change the past -She can't undo what's already been done -She can't take back their venomous words Or somehow make you forget all the pain you endured -Because even If she drives them away -you are soul your own worst enemy And the monsters outside -The paint of your resilience is chipping away -And you're clutching to your blade more desperately than before -Her pleas and promises are falling on deaf ears -And sometimes she wonders if all this sorrow is worth -the happiness she feels -When she's holding your hand -But then she remembers the girl -Who, at only fifteen -Was going to take her life -And she was clutching Just as desperately to that knife -but you saved her -And you've been saving her ever since She saw a light in your eyes, there was nothing left to fear -And now helplessly -She watches it disappear -She wants to be the savior, that you are to her -But no matter how hopeful she seems -She's optimistic in v ain -You say she can't make you happy, she can't end the pain -She speaks wistfully of future plans -She wishes on a star -Words turn into razors -You say you don't plan on making it that far -But she still loves you Just the way you are -And like a time bomb would -You'll explode -destroying everything in your path -And when you do -She'll have nothing left -Suicide is such a Shiite thing to expect 3. Thunderstorm ââ¬â 2014 -You taught me how to count beautifully -The seconds between -Thunder and lightning -As it shook the foundation of our world -You taught me -Not to be afraid -But baby there is a thunderstorm -Raging on outside -But I can only count -The days since you -All because -Of me 4.How to destroy an infection ââ¬â 2014 I need someone To help me get rid of these feelings The feeling that I'm disgusting But I've come to realize that No one can get rid of them No one They're a part of me And the only way to destroy the infection Is to attack at the root 5. My time is up. I am a firework, and I am becoming a part of something bigger. 11. My kind of alone ââ¬â 2014 People think of alone as A dark hole Where no sound and no light and no life can Penetrate But I don't think so because I have been down that hole many times before I have lived it and still I feel More at home there than Or a group full of friends But who knows Maybe our kind of alone is the sadder kind Because it's the kind that makes you Not fear death anymore 12.Letting go- 2014 Letting go of The one you thought you loved more than Anything More than Everything Is not like dropping someone off The edge of a cliff However badly you might wish it was It's not And no matter how long you Put it off This inevitable thing It will never be easier Just get it over with Oh but don't be fooled Getting it over with does not imply An instantaneous relief They aren't some bandit Holding together two infected halves Of a whole twisted heart Oh no Letting go Of someone you love Is a slow release A long painful exhale In a room starved for oxygen A Jet of helium Slowly streaming from that pinprick In the plastic skin of a young child's party balloon Who didn't get their birthday wish Poetry I picked this poem thinking this seems like a funny title and it would be a confusing poem that had a simple title but a deep meaning. This poem had a lot of alliteration the roots ere and re were repeated very often, and the only roots used in the poem. The only exception to this order was the the first line in verse five where minotaur was used. The minotaur was placed there conclude to break the steady rhyme. This is cleverly placed to bring the attention of the reader o the conclusion. Here is where/ You can get nowhereâ⬠This itself Starts the poem at a negative context and a feeling Of hopelessness. This in the poem represents life as being where you are your fate has decreed to be there is no point of struggling or trying to run away from it. All of life's problems are symbolized as the corn mazes twist and turns. ââ¬Å"Like any other/ You can't peer over/ And then another. â⬠The twisting turns in this poem like problems cannot e seen ahead of time you just run into them. When you are done dealing with one problem the next one appears. As we try to shape our destinies by ourselves we wake blindly not knowing what we do assuming we we are doing what's best for us. ââ¬Å"Your inner minotaurâ⬠is a psychological term which can mean your fear of the unknown or your destiny. In psychology it IS said that you walk on hands and knees blindly until you are able to confront your inner minotaur. Which coincidentally relates with the poem. But on you blunderâ⬠shows the severity of our method of pursuing our destiny. To summarize the poem I conclude that this poem shows the futility of life of how no matter how hard we try to run we have acknowledge in the end that we have accept we have go nowhere in life. Like the pace of the poem it goes at steady pace. I am able to connect many of the situations of this poem to my life it shows my problems and how they come unexpected.

Giving Doctors What They Need To Avoid Burnout Article...
The article I had read is, ââ¬Å"Giving Doctors What They Need to Avoid Burnoutâ⬠on the Harvard Business Review. The article discusses the topic of leadership in the healthcare industry. I have chosen to read about this article due to my father being in the medical industry and a business owner himself. It had caught my interest as with the recent health care reforms and changes in the medical field, it allowed me to take a front row perspective in seeing what my father is experiencing. A study has been conducted and analyzed the productivity, quality, services, happiness and overall success of doctors. Due to recent reforms in health care and changes with the affordable health care act, doctors are now having to work harder and increaseâ⬠¦show more contentâ⬠¦In order to properly understand the study correctly, it is important to understand the two major driving forces in which were used to measure and judge ââ¬Å"self-perceived capability.â⬠The first measure wa s the decision-making latitude they need to provide high quality care. The second is the necessary tools and resources. The physicians who perceived themselves as fully capable measured to be more productive and loyal. They were 61% less likely to show signs of burnout and 76% less likely to plan on leaving their current employers. This study has spread, measured, and has been tested on clinical teams as well. In short, it brought insight to the fact that physicians who work in groups that develop high performing teams enhance capability rather than rewarding individual physicians and rewarding an individual superstar. Practices in which valued teamwork more than individual performance is said to be over three times more capable and five times more willing to go above and beyond in their jobs and stay with their organizations. Furthermore, the study had showed that strong leaders are far more capable in motivating and cultivating capable physicians. To conclude, investing in persona l leadership skills and nurturing/developing strong leadership at all levels should be implemented for the health careShow MoreRelatedTheoretical Framework in Nursing Process - Elements, Approaches and Strategies of Theory Development2854 Words à |à 12 PagesPractice ââ¬â Module 3 A. The Chevauche Organised Medieval Murder
The chevauchà ©e was a particularly destructive kind of military raid prominent during The Hundred Years War (and especially used by Edward III of England). Rather than besieging a castle or conquering the land, soldiers on a chevauchà ©e aimed to create as much destruction, carnage and chaos as possible to both break the morale of enemy peasants and deny their rulers income and resources. Consequently, they would burn crops and buildings, kill the population and steal anything valuable before enemy forces could challenge them, often systematically laying regions to waste and causing great starvation. Comparison with the modern concept of Total War is more than justified and the chevauchà ©e makes an interesting counterpoint to the modern view of chivalrous medieval warfare and the idea medieval people avoided civilian casualties. The Chevauchà ©e in the Hundred Years War The chevauchà ©e used during the Hundred Years War emerged during the wars of the English and Scots, along with the defensive longbow tactics of the former. Edward III then took the chevauchà ©e to the continent when he warred with the French crown in 1399, shocking his rivals for his brutality. However, Edward was being careful: chevauchà ©es were cheaper to organize than sieges, needing far fewer resources and not tying you down, and far less risky than open battle, as the people you were fighting/killing were poorly armed, not armored and proved little threat. You needed a smaller force if you werenââ¬â¢t trying to win an open battle, or blockade a town. In addition, while you saved money it was costing your enemy, as their resources were being eaten away. Edward and fellow kings needed to conserve money as raising funds were very difficultââ¬â¢even if Edward did break new ground in marshaling Englandââ¬â¢s fundsââ¬â¢making the chevauchà ©e even more attractive. Edward III of England and Chevauchà ©e Edward made the chevauchà ©e key to his campaign for his entire life. While he did take Calais, and lower ranking English and allies kept taking and losing smaller scale locations, Edward and his sons favored these bloody expeditions. There is a debate about whether Edward was using the chevauchà ©e to draw the French king or crown prince into battle, the theory being you caused so much chaos and destruction that moral pressure mounted on the enemy monarch to attack you. Edward certainly wanted a quick show of god given right at times, and the victory at Crecy occurred at just such a moment, but many of the English chevauchà ©eââ¬â¢s were smaller forces moving swiftly precisely to avoid being forced to give battle and take that larger risk. What Happened After the Losses of Crecy and Poitiers After the losses of Crecy and Poitiers, the French refused to battle for a generation, and chevauchà ©es became less effective as they had to move through areas theyââ¬â¢d already damaged. However, while the chevauchà ©e certainly harmed the French, unless a battle was won or a major target took the English populace questioned whether the expense of these expeditions was worth it, and the chevauchà ©es in the later years of Edward IIIââ¬â¢s life are considered failures. When Henry V later reignited the war he aimed to take and hold rather than copy the chevauchà ©e.

Effects Of Falling Gas Prices On Operation Management...
The Effects of Falling Gas Prices on Operation Management Decision Making Dylan Knight Robert Morris University Abstract This paper briefly takes a look at how the price of gas has changed over the past ten years and what has caused the drop in fuel prices within the past few years. It then looks at the fuel priceââ¬â¢s effect on business operation through the eyes of the Operations Manager and the key aspects in decision making that they have to consider when the gas prices fall, like they have recently. I then give you an idea of how the falling prices effect the Apartment Management industry and the operations involved in renting and renovating apartments. Falling Gas Prices Effect on Operationsâ⬠¦show more contentâ⬠¦The one downfall of the increased production here in the United States is the drilling has slowed down drastically leaving many oil workers without a job and forcing some companies out of business. (Krauss) Another cause of the gas prices dropping, according to an article on CNN, is the economic slowdown of the Chinese economy. They also mentioned the increased production in the United States and finally the tentative nuclear deal which would make their oil more readily available to our country. In the article they also predicted that by the time football season came around that tens of thousands of gas stations across the country will be below the $2 a gallon mark. (Isidore) Even though we have seen it come close here in Pennsylvania, it has not gone below $2 here in the greater Pittsburgh area. A few times that I have been home in Ohio I have seen it drop below $2 but it ultimately just depends on which area you are in. With winter quickly approaching gas prices are expected to continue to drop as stations mix a less expensive blend of gas for the winter months.
